This i s a bit of a yarn, and I will have to be careful not to name names but here we go. In the days I used to have Facebook, users will know you get a constant stream of adverts. Some of them are ok, others are just scams. One caught my eye as it was a mop and bucket where the mop head was thick and really luxurious and you could imagine it soaking up water with ease. I ordered @ £26.99 with free delivery (LOL). When it turned up, the mop head looked nothing like the advertised product, instead resembling a bit of really cheap carpet.
I immediately contacted the company to reject it and they agreed. I asked them for a returns label and they refused of course. I pointed out that the mop head was neither of merchantable quality or as per the advertised product. I told them they had 7 days then without further ado would launch a Civil proceeding against them. I did and I won.
Now, you would think that would be the end of it but not a chance. The defendant ignored all correspondence and chance to comply. I then spent a month with my own Court who only get 3 our of 10. I emailed the courts this morning to be told the defendant had applied to have the case set aside but had failed to pay the court fees in time so the case was now closed. I said yes, but my question a month ago was how to enforce the judgement. They said by filling in form N323. I said i have 6 weeks ago. Ah, but have you paid the fee of £83? No I said. On the email I sent in with the form I asked how to pay and never received a response! Well they said. You need to send in form N323 again with your phone number, then someone will ring you to collect. Then we send the case on for you to the correct court who will recover using bailiffs if needed.
Now I will get a refund, of £26.99, plus £35 initial court fee plus a further £83. That is £144.99 instead of postage costs of about £3.95.
Luckily I am retired and have absolutely nothing better to do!
